Practice Areas

Defamation Defense

New York recently enacted a robust anti-defamation law to punish and deter baseless defamation lawsuits by awarding attorney fees and punitive damages to defendants in some cases. Our firm won one of the first major cases interpreting the scope of this law at the New York Supreme Court’s First Appellate Division, Aristocrat Plastic Surgery v. Silva . If you have been wrongly sued for defamation contact us to see what we might be able to do for you.

Appeals

Litigation carries with it many risks that are outside the complete control of your attorney. No matter how good a job an attorney might do, judges can and do make mistakes. We have experience in bringing appeals in both New York State and Federal courts. Other lawyers sometimes refer appellate cases to us because as a small firm we can offer more flexible fee and billing arrangements. New York allows only a short amount of time between when an adverse ruling occurs and when a litigant must begin the appeals process.

Commercial Litigation

We offer high quality commercial litigation services at a discount to the rates offered by New York and international AM Law 100 firms and often find ourselves in co-counsel or opposing counsel relationships with those firms. Our commercial litigation practice includes breach of contract, fraud, shareholder / member disputes or closely held companies, and other business-related matters. Commercial litigation often involves complex legal issues and your case may benefit from the superior education and experience of our attorneys.

Judgement Enforcement

Judgment enforcement refers to the process by which a court order or judgment is enforced against a debtor who has failed to pay the amount owed. Many civil litigation attorneys in New York State know how to obtain judgments but are at a complete loss when it comes to enforcing them. They simply do not practice this area of law. This is where we step in. We know your rights as a judgment creditor and will pursue judgment debtor doggedly for every dollar that can be lawfully extracted from their assets.

Unpaid Wages and Overtime

New York State, New York City, and Federal laws all provide for punitive damages and plaintiffs’ attorney fee awards in cases of wage theft. Both small employers and employees often wrongly believe that an employee’s undocumented immigrant status prevents the employee from suing for unpaid overtime and minimum wage violations. Retaliation against an employee for bringing an unpaid wages lawsuit is also punished. We have successfully defended many wage and hour cases for employers and prosecuted these cases for employees.
